Terms of Business

Sim & Skills Ltd sells products for training purposes only. Products purchased from us should not be used for patient care on humans or animals.

Payment

Payment options include bank transfer, all major credit and debit cards, and selected third-party payment services. Payment for non-credit account holders and all export orders must be made by cleared payment before despatch. The Seller reserves the right to decline certain types of payment without reason.

The Seller may also request payment before certain goods are ordered from suppliers from both account and non-account customers. Written orders from account customers by email which clearly show the originating organisation may be accepted as official orders. Purchase orders without a purchase order number will not be processed.

The Seller will accept no liability for erroneous ordering from within a Buyer's organisation. All valid product codes and quantities will be accepted as having been checked.

The Buyer must make full payment by the Invoice Due Date unless otherwise agreed in writing. The Buyer shall have no right of set-off and all invoices must be paid in full.

All overdue amounts will be charged statutory interest at 8% over and above the prevailing Bank of England base rate and any discounts will be disallowed. Overdue payments will also be subject to a debt recovery charge. 

Debt recovery costs:
Overdue bills up to £999.99: £40.00
£1,000 to £9,999.99: £70.00
£10,000 or more: £100.00

Credit Accounts

Public and Government Authorities, including NHS Trusts and Universities, may be treated as account customers upon receipt of written order, signed by a duly authorised officer. 

Distributor and Affiliate accounts are only provided for agreed bona fide distributors/affiliates.

New credit accounts may be opened upon receipt of two satisfactory trade references, full banking details, and with the agreement of Sim & Skills Ltd management. We will credit check the company and its directors, by requesting a credit application you agree to these checks. Unless agreed in writing, first orders will be charged upfront. Orders of £20,000+ within a 30-day period require a 50% deposit.

Any orders received are deemed to be in agreement with the Seller's terms. The Seller's terms always prevail over the Buyer's terms.

Delivery Charges

Tracked Delivery on website orders to a single Mainland Great Britain address is charged at £7.50 + VAT.

Tracked Delivery on purchase orders to a single Mainland Great Britain address is charged at £15.00 + VAT.

Palletised deliveries are charged at £85.00 + VAT per pallet.

Deliveries will be made to a Goods In area not a specific room/department.

Shipping to Northern Ireland and British Forces is charged at £25.00 + VAT.

International shipping is provided on a case-by-case basis, please contact us for a quote.

We reserve the right to refuse or cancel orders if we suspect a transaction to be fraudulent or in breach of agreements with our suppliers.

Due to the high value of the products we supply, a signature will be required upon delivery.

VAT (Value Added Tax)

VAT will be charged at the current UK VAT rate for all products, services and carriage charges except where specified.

In some instances, we may ship from locations outside of the UK. In this case, Sim & Skills will not charge VAT. Instead, a customs agent will contact the Buyer to arrange payment of VAT prior to delivery.

Customers claiming VAT under the zero-rated schedule must always submit a VAT Declaration Certificate along with a written order otherwise VAT will be charged and cannot be refunded. If the declaration is later challenged by HMRC, the customer will be liable for the VAT. Please note that not all products are eligible for zero-rating.

Product Warranty Statement

1. Warranty Coverage

Sim & Skills Ltd (“we,” “us,” or “our”) warrants that all healthcare simulation products (“Products”) sold by us will be free from material defects in workmanship and materials under normal use and service for a period of 12 months from the date of delivery to the original purchaser (“Customer”).

This warranty applies only to Products purchased directly from Sim & Skills Ltd or an authorised distributor and used in accordance with the manufacturer’s guidelines and recommended conditions.

Many of the manufacturers we work with offer a longer warranty period. Check the Specification tab on each product page for details.

2. Remedies Under Warranty

If a Product fails due to a defect in materials or workmanship within the warranty period, Sim & Skills Ltd will, at our discretion:

  • Repair the defective Product at no charge, using new or refurbished parts;
  • Replace the defective Product with an equivalent new or refurbished Product; or
  • Provide a refund of the purchase price if repair or replacement is not possible.

Any repaired or replaced Product will be covered for the remainder of the original warranty period or 90 days from the date of repair/replacement, whichever is longer.

3. Exclusions and Limitations

This warranty does not cover:

  • Normal wear and tear, cosmetic damage, or consumable parts (e.g., batteries, sensors, pads).
  • Damage caused by improper installation, maintenance, or use not in accordance with the manufacturer’s instructions.
  • Modifications, repairs, or alterations made by unauthorised personnel.
  • Damage due to external factors, including but not limited to accidents, abuse, misuse, fire, flood, power surges, or unauthorised software updates.
  • Products sold as “used,” “as-is,” or “refurbished,” unless otherwise stated in writing.

4. How to Make a Warranty Claim

To make a warranty claim, the Customer must:

  1. Notify Sim & Skills Ltd in writing within the warranty period at support@simandskills.com, providing proof of purchase and a description of the defect.
  2. Obtain a Return Authorisation (RA) number before returning the Product.
  3. Ship the Product to Sim & Skills Ltd (or an authorised service centre), ensuring it is safely packaged to prevent damage in transit. The Customer is responsible for return shipping costs unless otherwise agreed.

5. Consumer Rights & Limitations of Liability

This warranty is provided in addition to, and does not affect, the Customer’s statutory rights under UK consumer law, including the Consumer Rights Act 2015. If the Product is faulty, unfit for purpose, or not as described, the Customer may have the right to a repair, replacement, or refund.

Except as required by law, Sim & Skills Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Product, including but not limited to loss of business, revenue, or data.

6. Governing Law

This warranty is governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this warranty shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Title of Goods

Risk in the Goods shall pass on to the Buyer on delivery for UK customers and on despatch for all export orders. Title in the Goods shall not pass to the Buyer until final payment has been made. All goods remain the property of Sim & Skills Ltd until payment is received in full.

Delivery of Goods

Delivery dates given by the Seller are approximate only and do not form part of the contract. The Seller accepts no liability if delivery dates are not met. The Seller reserves the right to amend its prices without prior notice. Sim & Skills Ltd reserves the right to update its published prices.

The Buyer has the responsibility to check product pricing and any discounts or special prices at the time of ordering. Any requests for bulk pricing, export or tenders will be made on an ex-works basis only. Carriage is not quoted in the price list and will be charged at the current rate on all orders.

The Seller will endeavour to use the most cost-effective means of delivery but makes no guarantees regarding delivery.

When signing for the goods the customer should always ensure that the external packaging is not damaged or appears to have been tampered with if so this should be noted on the carrier's delivery sheet. Any damage should be reported on receipt and photographic evidence retained. This should be reported to both Sim & Skills Ltd and the courier driver.

Any alleged defects or delivery shortages must be notified, in writing by the Buyer to Sim & Skills Ltd within 3 days of delivery. Complaints in respect of alleged defects will not be grounds for the Buyer to withhold payments and give no right of set-off against the payment due from the Buyer to Sim & Skills Ltd.

Returns & Cancellations

Returns are acceptable within 28 days of delivery (by law you have 14 days to notify us and a further 14 days to complete the return), providing the item is in a resalable condition and in its undamaged original packaging.

Cancellations and Returns are free of charge for items up to 20 kg. Collection for items over 20 kg will be quoted on a case-by-case basis.

All returns must be pre-authorised prior to shipping. Unauthorised returns may be refused and additional carriage costs may be incurred.

Failure to return goods in a resalable condition may result in a restocking fee of £25.00 + VAT or 20% of the invoice value, whichever is greater.

Any goods returned for product defect or warranty issues will not incur a restocking fee, but must still have appropriate authorisation.

If your return is accepted, we’ll send you a return shipping label and instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

      All content included on our website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Sim & Skills Ltd, our affiliates or other relevant third parties. By continuing to use our website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws. Subject to exceptions detailed in the Copyright Designs & Patents Act 1988, you may not reproduce, copy, distribute, store or in any other fashion re-use material from the catalogue or website unless otherwise indicated on the website or unless given express written permission to do so by Sim & Skills Ltd.

      Errors & Omissions Excepted

      Every effort is made to keep our online pricing and content description error-free. In the event of an error in pricing, Sim & Skills Ltd reserves the right to withdraw a product from sale. All catalogue and internet photography and descriptions are intended as a guide to the products appearance and description only, all items pictured which are added to the core product are displayed for guidance purposes only unless otherwise specified in the product description. Sim & Skills Ltd operates a policy of continual improvement to its product range, items may be replaced with products of an equivalent or superior specification at any time.

      Credit Card Security

      Using your credit card to make purchases via our website is a secure way to pay for your goods and is made through a third party acquiring portal. All sensitive information, including personal details as well as credit card information, is held by the acquiring portal, no credit card information is stored by Sim & Skills Ltd. No historical information regarding credit cards is held by Sim & Skills Ltd.

      Furthermore, as required by the UK Data Protection Acts and GDPR regulations, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access.       Special Offers and Discount Codes

      From time to time we may use promotional discount codes or promotional site-wide discounts on the website to reduce the price of specified products. 

      Promotional discount codes must be used at the point of order and cannot be applied retrospectively. Each offer will have their own terms and conditions which will be stipulated on the advertised landing page when the promotion is active.
